TERMS & CONDITIONS

Welcome to Maison Élan, where we are devoted to elevating your wellness journey in an elegant, supportive, and respectful environment. By enrolling in our classes, purchasing any membership, package, service or product, you agree to the following terms and conditions.

1. Memberships & Payment

All memberships are charged on a fortnightly basis, beginning from your join date with no lock in period. Each payment covers a 14-day access period to the specified class inclusions. Workshops and special events excluded. Memberships may be cancelled or suspended in accordance with the terms below. All payments are securely processed via Momence and related payment system, with applicable card surcharges displayed at checkout. Memberships automatically renew unless cancelled with proper notice.

2. Elite Membership

The Elite Membership is an exclusive offering available to a limited number of members. It includes up to seven (7) classes per week, priority booking privileges of an additional day, access to members-only events, and 10% off all retail products. Elite Members may hold a maximum of two (2) active bookings per day. Members are welcome to bring one (1) guest per month, provided the guest is a new client who has signed up through the booking system prior to attending. Guest visits must be pre-booked and are non-transferable. Maison Élan reserves the right to amend membership inclusions or limits at any time with reasonable notice.

3. Pausing Your Membership

You may request a pause (suspension) of your membership at any period for a:

- Minimum duration: 1 week.

- Maximum duration: 12 weeks in a 12-month period.

Notice required: At least 3 days prior to your next scheduled payment.

Requests must be submitted in writing to: studio@maisonelan.com.au. Memberships must be active to be cancelled. Suspensions cannot be retroactive.

While a membership is on pause, bookings cannot be made. Any existing future bookings scheduled during a paused period will be automatically cancelled.

4. Cancelling Your Membership

You may cancel your membership after by providing at least 3 days’ written notice prior to your next payment. Cancellations must be submitted in writing to: studio@maisonelan.com.au or completed on your online profile. You will receive written confirmation once the cancellation has been processed. Refunds are not provided for payments already processed or for failure to provide sufficient notice.

5. Class Bookings & Attendance

Bookings open a minimum of 7 days in advance via our online platform, an additional day in advance for Elite Memberships. Out of courtesy to other clients and for safety reasons, entry will not be permitted after 5 minutes into the class. Please check in upon arrival. Failure to check in may be recorded as a no-show. If class numbers are limited, the teacher may deny entry at their discretion. Elite Memberships are limited to 2 bookings per day.

6. Cancellations & No-Shows

Group Classes: Cancellations must be made at least 10 hours prior to class start time. Late cancellations and no-shows forfeit the session booking. Private Sessions: Require at least 24 hours' notice to avoid being charged in full. Waitlists: If you are moved into a class from the waitlist, regular cancellation policies apply.

Customers can cancel their attendance and get a credit if they make it before the cancellation cut-off period. Tickets purchased using pre-paid/class packages or usage-limited subscriptions will be automatically added back to their package or usage limit. Other purchases will be returned as credits to the customer's account.

7. Studio Etiquette & Safety

Maison Élan reserves the right to:

- Cancel or reschedule classes, teachers or events at short notice due to unforeseen circumstances.

- Deny entry to clients who arrive late, are improperly attired, or lack medical clearance.

- Refuse service or terminate any class booking, memberships or purchase due at our discretion or due to offensive, inappropriate, unsafe behaviour.

We are not responsible for the safekeeping of personal belongings. By attending classes, you acknowledge that physical activity involves inherent risk.

8. Foundation Introductory Offer

Introductory offers are available to new clients only and may only be used once. Offers are valid for 5 classes from the date of your first class and must be used within the specified validity period (14 days). The offer must be used within 2 months of purchase. These offers exclude guest instructors, retreats, and special events. No refunds, transfers, suspensions or extensions are available on unused classes.

9. Return to You Introductory Offer

The Return to You – 28 Day Experience is an introductory offer for new clients only. Your 28 days commence from your first booked class and include unlimited access to all regular scheduled sessions, excluding workshops and special events. Bookings are essential, and cancellations must be made at least 10 hours before class. The offer is non-refundable, non-transferable, and cannot be paused or extended. A voluntary Wellness Check-In is available during your experience to support your goals. The advice is general in nature and recommended you consult with your healthcare professional. Your Welcome Gift may be collected in studio during your first visit.

10. Class Packs

5 - Class Pack: valid for 2 months from purchase.

Extensions may be granted only with a medical certificate. Class packs are non-refundable, non-transferable, and may not be shared.

11. Gift Cards

Gift cards are redeemable for classes or products and are valid for 3 years from purchase.

They are non-refundable, non-transferable, and may not be redeemed for cash. No extensions are granted for change of mind, illness or relocation.

12. Medical Holds or Termination

In cases of serious injury, illness or pregnancy, holds or early termination may be granted upon provision of a valid medical certificate. Requests must be made in writing 3 days prior to the next billing cycle.

13. Pregnancy and Medical Clearance
Your wellbeing is our highest priority. If you are pregnant, become pregnant, or believe you may be pregnant, we kindly ask that you inform your instructor before beginning any session so we can support you safely and appropriately.

You agree to seek guidance from a qualified healthcare professional to confirm your suitability to participate in Maison Élan classes or services. By choosing to take part in any classes or services, you acknowledge that you have independently assessed your readiness and accept responsibility for your participation.

If at any point you need to rest, please do so. Listening to your body is essential and always encouraged.

Maison Élan may request medical clearance at any time and may respectfully pause your attendance until documentation is provided.

14. Refunds & Returns

All sales are final. We do not offer refunds for change of mind, injury, illness, relocation, or unused sessions. Refunds will not be issued once a payment has been processed unless required by law or due to verified system error. In rare cases of system failure or incorrect charge, a $1 administrative fee may be deducted from any refund.

15. Product Purchases & Returns

All product sales made through Maison Élan, whether in studio or online, are final. We do not offer refunds or exchanges for change of mind, incorrect selection, or personal preference. In accordance with Australian Consumer Law, refunds or replacements will only be provided where a product is deemed faulty, unsafe, or significantly different from its description. To make a claim under this warranty, you must notify Maison Élan via studio@maisonelan.com.au within a reasonable timeframe and provide proof of purchase. Maison Élan reserves the right to assess the product before determining an appropriate remedy.

16. Pricing & Policy Changes

All pricing and terms are subject to change. Clients will be notified at least 4 weeks in advance of any change to weekly membership pricing. The most up-to-date version of our terms will always be available at: www.maisonelan.com.au/terms-conditions.

17. Liability & Risk Acknowledgement

By participating in any class, service, workshop or event at Maison Élan, you acknowledge and accept the following:

- Physical movement and exercise carry inherent risks. You participate entirely at your own risk.

- You confirm that you are medically fit to participate and will seek medical advice if unsure.

- You agree to inform your instructor of any injuries, illnesses, or pregnancies prior to class.

- Maison Élan is not liable for any personal injury, property loss or death sustained during participation.

- You, your heirs and legal representatives waive and release all claims against Maison Élan.

- We are not responsible for lost or stolen personal property.

18. Agreement

By purchasing any class, membership or package, or by attending any session at Maison Élan, you confirm that you have read, understood, and agreed to these terms and conditions. If you have any questions, please contact us at studio@maisonelan.com.au.
